Terms of Service & Platform Governance Agreement
Governing technical registry utilization, AES-256 data custody, mandatory Act 843 biometric calibration, estate discovery fees, and statutory non-underwriting boundaries.
1. Preamble, Binding Agreement & Capacity
This Terms of Service and Platform Governance Agreement (the "Agreement") constitutes a legally binding contract entered into between InheritanceBox ("InheritanceBox", "the Platform", "we", "us", or "our"), having its principal service address at 9 Sibis Street, Accra, Ghana, and any individual, entity, policyholder, subscriber, next-of-kin, or claimant ("User", "Policyholder", "Claimant", or "you") accessing, browsing, registering an account on, or querying the software infrastructure accessible via inheritancebox.com and its affiliated subdomains.
By creating a citizen vault, initiating a national registry search, uploading estate records, completing biometric facial calibrations, or submitting payment credentials, you affirm and warrant that:
- You are at least eighteen (18) years of age with full legal capacity under the laws of the Republic of Ghana to enter into legally enforceable agreements;
- You have read, thoroughly understood, and unreservedly accept all covenants, disclaimers, liability caps, and governance protocols contained herein; and
- If you access the platform on behalf of a family lineage council, corporate enterprise, or group insurance policyholder scheme, you hold certified legal authority to bind said entity to this Agreement.
2. Technology Intermediary Classification & Non-Underwriting Disclaimers
2.1 Zero Payout Liability: InheritanceBox does not underwrite, sell, issue, manage, or financially back any insurance policy, asset class, pension plan, or investment security. We bear zero legal, statutory, or financial liability for the approval, adjudication, payout, partial settlement, reduction, dispute, delay, or rejection of any insurance claim filed with any underwriting firm (including, but not limited to, Enterprise Life, SIC Insurance, StarLife Assurance, GLICO General, Hollard Insurance, Vanguard Assurance, or any other underwriter).
2.2 Direct Insurer Jurisdiction: All statutory claim reviews, assessments of insurable interest, terms of cover, exclusion clauses, and death benefit disbursements rest solely under the independent authority and underwriting contracts of the respective insurance company.
2.3 Absence of Agency: The citation, listing, or rendering of corporate logos, trademarks, or trade names on the Platform serves exclusively as an informational directory locator for user convenience. Such appearances do not establish an agency relationship, partnership, joint venture, fiduciary alliance, or official endorsement between InheritanceBox and the referenced financial institutions.
2.4 No Legal or Probate Practice: Cataloging copies of wills, indentures, deeds, statutory declarations, or family tree lineages on InheritanceBox does not constitute formal testamentary execution, legal probate, or legal advice. Ghanaian estate statutes, the Administration of Estates Act, 1961 (Act 63), and High Court Letters of Administration supersede any informal or uncertified designations stored on the Platform.
3. Accuracy of Records & Sole Policyholder Responsibility
InheritanceBox operates on a zero-knowledge data custody model. The Platform does not independently audit, verify, or warrant the real-world accuracy or active standing of records uploaded by users.
- Sole Custodial Warranty: The Policyholder bears sole and exclusive responsibility for ensuring that all policy reference numbers, underwriter names, bank account numbers, branch identities, Treasury Bill serials, property indentures, family lineage trees, and next-of-kin contact points are accurate, current, and legally owned by the Policyholder.
- Garbage-In, Garbage-Out Protection: InheritanceBox accepts zero liability in instances where a surviving relative fails to discover, verify, or claim an active estate benefit due to typographical errors, expired policy numbers, fraudulent documents, lapsed premiums, omitted family records, or inaccurate Ghana Card identifications submitted by the Policyholder.
4. Statutory Biometric Authentication & Data Protection Compliance
4.1 Express Biometric Consent: To prevent fraudulent liquidation, unauthorized asset snooping, and estate identity theft, InheritanceBox enforces a mandatory Three-Angle Facial Biometric Calibration (Front Profile, Left Profile, and Right Profile) paired with Ghana Card ID validation prior to provisioning any claimant dossier. By enabling your camera and completing the scan, you grant express, unambiguous, and irrevocable consent to InheritanceBox to capture, analyze, and cryptographically hash your facial geometry.
4.2 Forensic Audit Depository: You expressly acknowledge that your biometric images, audio calibration metrics, device operating environment, public IP address, and network timestamps are permanently preserved in an immutable, tamper-proof security audit vault. These records are maintained to provide conclusive forensic proof of identity in the event of subsequent criminal investigation or estate litigation.
4.3 Prohibition of Living Citizen Surveillance: Searching the registry using the Ghana Card of a living individual without certified, written power of attorney or explicit legal authorization constitutes unlawful personal data processing under Act 843 and will trigger immediate session termination, identity blacklisting, and referral to the Data Protection Commission.
5. Fee Structure, Billing Lifecycle & Strict Non-Refundability
All financial payments processed through the Platform are executed securely via certified payment gateways, including Paystack.

5.1 Administrative Nature of Unlock Fees: The GHS 50.00 Discovery Unlock Fee is charged strictly for administrative data indexing, biometric verification, and the dynamic synthesis of the Claimant Dossier. Payment of this fee does not guarantee that the policyholder's insurance policy holds an active cash value, nor does it guarantee that the underwriter will disburse payment. Under no circumstances will a refund be issued on the basis that a discovered policy has lapsed, is exhausted, is contested, or is rejected by an insurance company.
5.2 Recurring Billing Authorization: By subscribing to an annual plan, the Policyholder authorizes InheritanceBox to automatically debit the designated card or Mobile Money account via Paystack until formal cancellation is completed inside the subscriber dashboard prior to the renewal date.
6. Post-Mortem Inactive Account Protocol
To balance individual privacy during life with rightful estate continuity upon demise, InheritanceBox operates under a strict four-stage protocol:
7. Anti-Fraud Policy & Statutory Criminal Penalties
7.1 Criminal Code Violations: Any individual who knowingly provides fraudulent details, impersonates a deceased citizen's next-of-kin, submits forged Letters of Administration, or attempts to circumvent biometric checks commits an indictable offense under Sections 131 through 133 of the Criminal Offences Act, 1960 (Act 29) (Defrauding by False Pretences) and the Cybersecurity Act, 2020 (Act 1038).
7.2 Police & Underwriter Referral: Upon the automated or manual detection of identity spoofing or fraudulent document submission, InheritanceBox will immediately furnish the offender's complete dossier—including uncompressed 3-angle facial images, uploaded documents, IP records, and phone numbers—to the Criminal Investigation Department (CID) of the Ghana Police Service and affected underwriter fraud units.
8. Limitation of Liability & Comprehensive Indemnification
8.1 Consequential Damages Waiver: To the fullest extent permitted by Ghanaian law, neither InheritanceBox, nor its directors, officers, software engineers, or infrastructure partners shall be held liable for any indirect, incidental, special, punitive, consequential, or exemplary damages. This includes, without limitation, loss of estate inheritance, loss of insurance proceeds, delays in underwriter claim processing, emotional distress, system downtime, or family estate litigation expenses.
8.2 Absolute Cumulative Liability Cap: Under all circumstances, the maximum aggregate liability of InheritanceBox for any claims arising out of or related to this Agreement or platform use, whether in contract, tort (including negligence), or statutory breach, shall not exceed the lesser of:
- The total fees paid by the user to InheritanceBox in the twelve (12) months preceding the event giving rise to liability; or
- The fixed sum of Five Hundred Ghana Cedis (GHS 500.00).
8.3 User Indemnification: You agree to defend, indemnify, and hold harmless InheritanceBox and its directors against any claims, damages, liabilities, losses, costs, and expenses (including legal fees) arising from:
- Your breach of any provision of this Agreement;
- Inaccurate, incomplete, or fraudulent asset details uploaded to your vault;
- Inter-familial disputes, inheritance lawsuits, or probate challenges concerning assets cataloged in your vault; or
- Your violation of third-party privacy rights under Act 843.
9. Governing Law, Mediation & Compulsory Arbitration
9.1 Governing Law: This Agreement, its interpretation, and performance shall be governed exclusively by and construed in accordance with the laws of the Republic of Ghana.
9.2 Mandatory Mediation: In the event of any dispute or controversy arising out of or relating to this Agreement, the parties shall first attempt in good faith to resolve the dispute through private mediation in Accra, Ghana, for a mandatory period of thirty (30) calendar days following formal written notice.
9.3 Binding Arbitration (Act 798): If the dispute is not resolved within thirty (30) days of mediation, it shall be finally resolved by binding arbitration under the rules of the Alternative Dispute Resolution Act, 2010 (Act 798) at the Ghana Arbitration Centre in Accra. The tribunal shall consist of a single arbitrator appointed jointly by the parties, or failing agreement within 14 days, by the Chairperson of the Ghana Arbitration Centre. The arbitration shall be conducted in English, and the arbitral award shall be final and enforceable in any court of competent jurisdiction in Ghana.
9.4 Waiver of Class Actions: All proceedings must be initiated on an individual basis. Users expressly waive any right to bring or participate in class actions, consolidated actions, or representative proceedings against InheritanceBox.
10. Modifications, Severability & Entire Agreement
10.1 Revisions: InheritanceBox reserves the operational authority to update or amend this Agreement at any time. Material amendments will be highlighted on the platform with an updated "Effective Date." Continued use of platform services following publication constitutes binding acceptance of the updated terms.
10.2 Severability: If any provision of this Agreement is deemed invalid, unlawful, or unenforceable by an arbitrator or court of competent jurisdiction, that specific provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
10.3 Entire Agreement: This Agreement, together with the Privacy Policy and embedded modal consent notices, constitutes the entire and exclusive agreement between the User and InheritanceBox, superseding all prior oral or written communications, drafts, or proposals.
